KCare Terms of Service

Effective date: August 20, 2026

These Terms of Service ("Terms") govern access to and use of KCare.app and KCare-powered scheduling, consent, payment, and administration services (the "Services"). By using the Services, you agree to these Terms.

1. The KCare service

KCare provides software tools that help care practices publish booking pages, display services and availability, collect operational information, present policy or consent acknowledgements, process payment handoffs, and manage booking-related workflows.

2. No medical advice or emergency services

KCare is a technology service and does not provide medical, behavioral health, legal, tax, or financial advice. Care services are provided by the applicable practice or provider, not by KCare. KCare is not for emergencies. If you are experiencing a medical or mental health emergency, call 911, 988, or your local emergency number.

3. Practice responsibility

Practices are responsible for the accuracy of their pages, services, availability, prices, cancellation rules, consents, policies, and communications. Practices are also responsible for determining whether KCare is appropriate for their professional, regulatory, privacy, and recordkeeping obligations.

4. User responsibilities

You agree to provide accurate information, use the Services only for lawful purposes, respect the rights of others, keep login credentials secure, and avoid interfering with or attempting to reverse engineer, overload, scrape, or misuse the Services.

5. Bookings, payments, cancellations, and refunds

Bookings may be subject to practice-specific confirmation, payment, cancellation, rescheduling, and refund rules. Payment processing may be handled by third-party payment providers. KCare is not responsible for a practice's care services or for disputes between a client and a practice.

6. Integrations

Practices may authorize integrations such as Google Calendar, payment processors, email tools, or other services. Your use of third-party integrations may also be governed by those providers' terms and privacy policies.

7. Intellectual property

KCare and its software, designs, workflows, trademarks, and content are owned by KCare or its licensors. Practices and users retain rights in content they submit, but grant KCare the rights needed to host, process, transmit, display, and operate that content as part of the Services.

8. Service changes and availability

We may update, suspend, limit, or discontinue parts of the Services at any time. We work to keep KCare reliable, but we do not guarantee uninterrupted or error-free availability.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, KCare will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the Services.

11. Indemnity

If you are a practice or administrator, you agree to defend, indemnify, and hold KCare harmless from claims arising from your content, services, professional obligations, use of the Services, or violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on KCare.app with a new effective date. Continued use of the Services means you accept the updated Terms.
